VILLAGE OF ORISKANY FALLS LOCAL LAW #2 “Prohibited Parking” OF 2004 PROPOSED:
May 17, 2004 Adopted: June 21, 2004I. Legislative Intent. It is the established policy
of the Village of Oriskany Falls that the safe and orderly movement of vehicular
and pedestrian traffic in and about the streets of the Village of Oriskany
Falls is essential to the public welfare and this local law is adopted for the
purpose of promoting such policy. II. Definitions. Park or
parking: The stopping of a
vehicle, whether or not attended or occupied, for an interval of time longer
than necessary for loading. Curb line. The street side edge of
any curbing of concrete, bituminous or other substance lining a Village street
or avenue, or in the absence of such curbing, the edge of the street pavement. III. Prohibition. A. It shall be unlawful and in violation of this
local law for any person to park, and for any person to cause, allow, permit or
suffer any vehicle registered in their name, or operated by them, to be parked
between the curb line of any street in the Village and the interior sidewalk
line. B. It shall be unlawful and in violation of this
local law for any person to park, and for any person to cause, allow, permit or
suffer any vehicle registered in their name, or operated by them, to be parked
overnight (between the hours of 2 AM and 6 AM) on any street in the Village
during the months between and including November and April of each year. C. It shall be unlawful and in violation of this
local law for any person to park, and for any person to cause, allow, permit or
suffer any vehicle registered in their name, or operated by them, to be parked
on the South side of Main Street from the Madison Street intersection west to a
spot 100 feet west of the village post office for more than a one (1) hour
duration during the normal workweek of Monday through Friday inclusively
(holidays excluded) between the hours of 7 AM and 5 PM. IV. Violation. Every person who shall
violate any provision of this local law shall be guilty of an offense
punishable by a fine of not more than twenty-five dollars ($25) for the first
offense and a fine of not more than one hundred dollars ($100) for any
additional offense within twelve (12) months of any previous violation. V. Conflicts and Separability. A. CONFLICTS:
All local laws or parts of
local laws in conflict herewith are hereby repealed. B. SEPARABILITY:
If any clause, sentence, paragraph, section or part of this local law shall be
adjudged by any court of competent jurisdiction to be invalid, such judgment
shall not affect, impair or invalidate the remainder thereof, but shall be
confined in its operation to the clause, sentence, paragraph, section or part
thereof directly involved in the controversy in which such judgment shall have
been rendered. VI. Local Law in Force. This local law shall take
affect upon its being duly filed with the Secretary of State of the State of
New York.
