ARTICLE 1.0 - GENERAL PROVISIONS
Article
5.0 Provisions For Operation And Maintenance Of On-Site Facilities, Section 5.2
On-Site Facilities Inspection and 5.5 Pumping, of Local Law #3 "Sewer Use
Law" of 2000 is hereby amended to read;
Section
1.1 On-Site Facilities Inspection
The Superintendent or an authorized
agent shall inspect the on-site facilities of all users of sewer services to
determine whether the facilities are operating properly. The scope and
frequency of the inspection shall be at the discretion of the Superintendent.
Section 1.2 Pumping
The septic tanks of all users of
sewer services in the Village shall be pumped out at a rate determined by the
Superintendent. The Superintendent or an authorized agent shall carry out
pumping. No property owner shall refuse to have their septic tank pumped.
The Superintendent or Assistant Superintendent shall
be physically present at all septic tank pumping and shall complete the Village
of Oriskany Falls septic tank inspection and pump out form for each property.
Copies of all forms are to be filed with the Village
Clerk for the purpose of record keeping and billing of additional pumping
charges if applicable. The Village Clerk will send notification of the date of
each pumping to the respective property owner.
ARTICLE 2.0 - CONFLICTS AND SEPARABILITY
Section 2.1 Conflicts
All local laws or parts of local laws in conflict
herewith are hereby repealed.
Section 2.2 Separability
The invalidity of any section, clause, sentence, or
provision of this local law shall not affect the validity of any other part of
this local law that can be given effect without such invalid part or parts.
ARTICLE 3.0 LOCAL LAW IN FORCE
This local law shall be in full force and effect from
and after its passage, approval, recording, and publication as provided by
state and local law.
